Marcos A. Colono was indicted yesterday by a Middlesex County Grand Jury in connection with the Rape of an 11 year old boy in Cambridge this past August, as well as for brutally assaulting the boy’s father who came to his son’s defense.

He was charged with two counts of Rape of a Child by Force; Home Invasion; and Armed Assault to Murder. Following his arraignment in Cambridge District Court last month, he was ordered held on $1 million bail.

As previously reported in the Boston Criminal Lawyers Blog, the Middlesex County District Attorney’s Office alleges that Colono entered the victims’ apartment with a large butcher knife and forced the 11 year old boy to lie on top of his father while he searched the home for things to steal. He then allegedly brought the father and son to a bedroom, where he assaulted the boy at knifepoint. Upon the boy resisting Colono’s demands, he allegedly stabbed the father 8-10 times in the neck, and 3 times in the back, almost severing his head.

A Lawrence man was the victim of a carjacking earlier this afternoon in Lawrence, Massachusetts. According to the Lawrence Police Department, the man was carjacked by two men known to him, and after the attack, the victim tracked the men down, whom he apparently knew.

When Police found the vehicle, occupied by the two carjacking perpetrators, they discovered the driver, one of the suspects, had been shot in the stomach, allegedly by the victim of the carjacking. The victim of the carjacking is to be charged with Assault with Intent to Murder, Assault with a Dangerous Weapon, Unlawful Possession of a Firearm, Unlawful Possession of Ammunition, and Possession of a Loaded Firearm.

Meanwhile, the two carjacking perpetrators are to be charged with Carjacking and Assault with a Deadly Weapon. All men are expected to be arraigned tomorrow morning in Lawrence District Court on their respective charges.

Kyle Alleyne, 25, of Framingham, Massachusetts, was indicted for Murder Charges by a Middlesex County Grand Jury in connection with the death of his wife, Heather Alleyne, 19, whose body was found in the couple’s home on August 9th.

According to the MIddlesex County District Attorney’s Office, Kyle Alleyne has been indicted for First Degree Murder, Assault & Battery, and Reckless Endangerment of a Child.

The body of Heather Alleyne was found on August 9th after her family asked the Framingham Police Department to conduct a well-being check. Police Officers responded to the couple’s apartment and discovered her body, and reported obvious signs of a struggle, blood and an attempted clean up of evidence.

A Cambridge man, who had already been released on bail on earlier Drug Charges, was re-arrested and arraigned in Brighton District Court this morning for stabbing a Boston College student in Newton on September 25.

The defendant, Francisco “Wizz” Ramirez, 18, of Cambridge, was arraigned in Brighton District Court on criminal charges including Assault & Battery with a Dangerous Weapon for stabbing Jeremiah Hegarty.

Boston Police, Newton Police and Massachusetts State Police involved in the stabbing investigation report that Ramirez stabbed the Boston College student near his dormitory after 3:00 a.m. on the morning of September 25. The incident was allegedly initiated when Ramirez, along with four other people, tried to gain access to the dorm. When they were told to leave, a physical altercation ensued that resulted in one student getting kicked, and Hegarty being stabbed.

Robert Curley, 32, was charged with beating his girlfriend over a period of two hours in his home in Revere last week. According to the Suffolk County District Attorney’s Office, Curley repeatedly punched and kicked his girlfriend in the head and all over her body.

At one point during the alleged incident, when the girlfriend tried to escape and call the police, he took her cell phone and dragged her back into the home. According to prosecutors, after the beating, he promised to take her to the hospital, but only if she agreed to tell the doctors that she fell.

Curley was arraigned in Chelsea District Court on several Crimes of Violence Charges, including Mayhem, Assault & Battery with a Dangerous Weapon, Kidnapping, and Intimidation of a Witness. Following his arraignment, a Dangerousness Hearing was held and Curley was held without bail, the judge finding that no bail or conditions of release would assure the safety of the community.

Massachusetts State Trooper Timothy Walsh was arraigned on Monday on DUI-related charges and for pulling his gun on an off-duty Boston Police Officer. He was arraigned this past Monday for Operating Under the Influence of Alcohol, Assault with a Dangerous Weapon, Illegal Discharge of a Firearm and other related Drunk Driving Charges.

Walsh is alleged to have hit several cars early this past Saturday morning on Boston Street. A Boston Police Officer who lives on the street responded to the incident, and Walsh then allegedly pointed his gun at him. Boston Police further allege that Walsh then went into the Boston Police Officer’s home and fired his gun.

As a result of this incident and his arrest, Walsh was indefinitely suspended without pay. He is an 18 year Army Veteran who served in Afghanistan. At his arraignment in Dorchester District Court, he was released on Personal Recognizance but ordered to remain alcohol-free; submit to random alcohol breath tests, and to submit to a Mental Health Evaluation.

Vandie Porter, 67, of Wayland, Massachusetts, was arrested yesterday morning for allegedly attempting to kill or maim after a fight broke out at a Sudbury gas station between him and another man and his son.

Sudbury Police allege that Porter ambushed the unnamed victim after he exited the Valero Gas Station in Sudbury and immediately began assaulting him. Porter also allegedly threatened to kill him and his entire family. Although it is unclear what prompted the altercation, Sudbury Police believe that the two men were acquainted with one another and that this was not a random incident.

Vandie Porter was arrested and charged with Assault & Battery, Attempted Murder, and Threats to Commit Murder.

A 3-month long investigation involving 20 different law enforcement agencies came to fruition today when police announced that 47 purported gang members were arrested.

Leading the investigation was the United States Immigration and Customs Enforcement (“ICE”) which led all law enforcement agencies. Of the 47 persons arrested, 23 face deportation and 28 were reportedly reputed gang members belonging to various gangs, including the Bloods, Latin Kings, and MS-13.

Law enforcement officials made this announcement today as they proudly advertised that many of those apprehended had been involved in what they describe as “violent crimes”, specifically Attempted Murder and Assault to Commit Rape. Notably, despite their having been labeled as gang members, none of the men apprehended were characterized as convicted felons, or having actually been convicted of the crimes of Attempted Murder and Assault to Commit Rape.

Hector Guardiola, 25, of South Boston, Massachusetts, was arraigned today in Roxbury District Court on charges of Manslaughter and Assault & Battery with a Dangerous Weapon in connection with an incident at a Lansdowne Street pub that resulted in the death of Michael DiMaria.

DiMaria, who lived in New York, was in Boston visiting with old friends from college and the group went to a pub on Lansdowne Street to spend some time together.

According to the Suffolk County District Attorney’s Office, prosecutors allege that a trivial argument broke out at the pub because one of the men in DiMaria’s group accidentally brushed against Guardiola as he was going to the bathroom. An argument allegedly ensued and DiMaria’s friend walked back to the table. At that point, Guardiola allegedly threw a beer mug, which shattered after hitting something and shards of sharp glass struck DiMaria, cutting his jugular vein.
